This is an information that is provided pursuant to art. 13 Privacy Code - Legislative Decree 30.6.2003, n. 196, and Art. 13 and 14 of EU Reg. 2016/679 (European Regulation for the protection of personal data) and is also inspired by the provisions of Directive 2002/58/CE, as updated by Directive 2009/136/CE.   1. PERSONAL DATA:

Personal data are specific information regarding personal or factual characteristics concerning a specific or determinable natural person pursuant to art. 2 Privacy Code. This category includes information such as your personal name, your address, your telephone number, email, your tax code, bank details. Information that cannot be linked directly to your person - for example your favorite sites or the number of users of a certain site - is not considered personal data.

  1. DATA COLLECTED ON LINE

On CONTACTS page of the site, you will be asked to provide personal data. In this case, you will be provided with the information pursuant to art. 13 of Legislative Decree 196/2003 and of the art. 13 and 14 of the GDPR 679-16 concerning the processing of personal data, before proceeding with the registration of your data.

The personal data of natural persons who fill in the CONTACTS form are processed to fulfill their requests.

The personal data of natural persons who fill in the CONTACTS form are lawfully processed for the execution of a contract of which the interested party is a party or execution of pre-contractual measures adopted at the request of the same (the request sent).

Apart from what is specified in this privacy policy for navigation data and in the specific information pursuant to art. 13 of Legislative Decree 196/2003 and of the art. 13 and 14 of the GDPR 679-16 for data collected online, the provision of data for further purposes and methods of processing is optional. Failure to provide them may make it impossible to pursue these additional purposes.

  1. PURPOSE OF DATA PROCESSING and AUTOMATED DECISION-MAKING PROCESSES

ALPER SRL will process the personal data provided in compliance with the conditions of lawfulness pursuant to art. 6 EU Reg. 2016/679 for the following purposes:

  • Purposes related to the management of the contractual relationship and the provision of the Services: the data will be processed for the following purposes:

- in order to pursue pre-contractual purposes for reaching a contractual agreement, for example sending estimates;

- in order to provide communications relating to the performance of the contractual relationship established, for example, order management, customer support service to the customer.

6.2. Purpose of fulfilling obligations established by law, regulations or EU regulations:

- in order to allow the Data Controller to fulfill the obligations established by law, regulations or EU regulations;

- in order to prevent or discover fraudulent activities or abuses harmful to the Site for the pursuit of the legitimate interest of the Data Controller or third parties, provided that the interests or fundamental rights or freedoms of the interested party do not prevail;

- in order to manage any complaints and / or disputes.

6.3. Purpose of allowing users to register on the Site:

- in order to allow the registration of Customers on the Site. The Customer is informed that access and navigation of the Site are free, but the possibility of entering into the Agreement with ALPER SRL is only allowed after the Customer has registered.

For the purposes referred to in letters 6.1, 6.2. and 6.3 the express consent of the interested party is not required, pursuant to art. 24, lett. a) - b) - c) - g) of the Privacy Code and art. 6, par. 1 letter b) - c) - f) of the G.D.P.R., being a necessary treatment.

Their failure, partial or incorrect conferment could result in the impossibility of providing you with the services offered by the Site.

6.4. Purposes related to marketing activities: ALPER SRL does not send newsletters or communications of a commercial and / or promotional nature.

  1. AUTOMATED DECISION-MAKING PROCESSES

The Data Controller does not carry out treatments that consist of automated decision-making processes.

  1. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE DATA

The Personal Data may be brought to the attention of employees or collaborators of the Data Controller who, operating under the direct authority of the latter, process data and are appointed internal managers or persons in charge of processing pursuant to art. 29 and 30 of the Code and art. o System administrator and who will receive adequate operating instructions from the Data Controller in this regard; the same will happen - by the Managers appointed by the Data Controller - towards the employees or collaborators of the Managers.

Personal Data may also be brought to the attention of the Controller's external managers, appointed pursuant to art. 28 of EU Reg. 2016/679, as third-party companies or other subjects that carry out outsourced activities on behalf of ALPER SRL.

Categories of External Data Processors:

  • third party suppliers, producers, distributors, resellers and commercial partners of ALPER SRL;
  • persons, companies or professional firms, who provide assistance, consultancy or collaboration to ALPER SRL in accounting, administrative, legal, tax and financial matters relating to the execution of the contract;
  • credit institutions for profiles relating to the fulfillment of collections and payments;
  • the companies that carry out outsourcing activities on behalf of ALPER SRL including the IT technicians who manage the websites and the related electronic communication infrastructures necessary for this, appointed as data processors; where appointed as data processors; appointed as data processors;

The user acknowledges that any indication (for example in the compilation of the registration form on the Site) of data of any third party other than the interested party represents a processing of personal data with respect to which he acts as an independent holder, assuming all the obligations and responsibilities provided for by the Privacy Code and the European Regulation pursuant to art. 679-16. In this sense, the user guarantees to ALPER SRL that any data of third parties which will be indicated by the user (and which will consequently be treated as if the third party had provided their own informed consent to the processing, where mandatory) has been acquired. by the user himself in full compliance with the Privacy Code and the European Regulation pursuant to art. 679-16. The user grants the widest indemnity on this point with respect to any dispute, claim, request for compensation for damage from processing, etc that should reach ALPER SRL from any third party concerned due to the provision of the data indicated by the user in violation of the applicable personal data protection rules.

  1. PLACE, PROCESSING METHOD and STORAGE PERIOD

Personal Data are mainly processed at the headquarters of the Data Controller and in the places where the External Data Processors are located. For further information, please contact the Data Controller.

In compliance with the provisions of art. 5 paragraph 1 letter. e) of EU Reg. 2016/679 the personal data collected will be stored in a form that allows identification of the data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed, and in any case deleted without unjustified delay.

The Owner has adopted a wide variety of security measures to protect you against the risk of loss, abuse or alteration of your Data. In particular: it has adopted the measures referred to in Articles. 32 - 34 Privacy Code;

uses the Data encryption technology established by the AES Standards and the protected data transmission protocols known as HTTPS; complies with the ISO / IEC 27000 Standards. The site does not keep any personal data as the surfer is not required to register. The Servers are subject to an advanced and daily backup system.

The data will not be disseminated or communicated to external parties in any way, without prejudice to the obligations in this sense provided for by law.

  1. DATA TRANSFER EXTRA UE

The Website does not share, sell, transfer or otherwise disseminate your personal data to third parties located in a third country and / or to international organizations and will continue not to do so in the future, except as required by law, unless necessary. for the purposes set out in the contract or you have not given your explicit consent to such processing.

For needs strictly related to the execution of the contract and the provision of services, some of your data may be disclosed to third parties (Agents / Suppliers), based in non-European third countries.

The Microsoft Cloud Platform is used for the management of emails, so the data could be transferred to the USA. Microsoft adheres to the principles of the Privacy Shield frameworks between the European Union and the United States and Switzerland and the United States.

  1. MINORS

The Website contains virtually no information intended directly for minors. Minors must not provide information or personal data to ALPER SRL in the absence of the consent of the exercisers of parental responsibility over them. Therefore, ALPER SRL invites all those who exercise parental responsibility on minors to inform them about the safe and responsible use of the Internet and the Web and to put in place any procedures indicated from time to time in relation to the initiatives in which ALPER SRL intends to process the data of minors.

  1. MODIFICATION OF THE INFORMATION

Where the website contains links to other websites or services owned or controlled by third parties, ALPER SRL is not responsible for the privacy policies or practices of such third party websites or services. Withdrawal of consent

With reference to art. 23 of Legislative Decree 196/2003 and art. 6 of the GDPR 679/16, the interested party can revoke the consent at any time.

Proposition of a complaint

The interested party has the right to lodge a complaint with the supervisory authority of the state of residence.

Exercise of one's rights

You will be able to assert your rights as expressed by the articles. 12,13,14,15, 16, 17, 18, 19, 20, 21, 22 and 23 of EU Regulation 2016/679, by contacting the Data Controller, by writing to the address: privacy@alper.it.

You have the right, at any time, to ask the Data Controller for access to your personal data, transformation into anonymous form, copying, updating, rectification, cancellation of the same, limitation of processing, blocking of data processed in violation of the law in accordance with the provisions of art. 7 of Legislative Decree 196/2003 reported and by articles 12,13,14,15, 16, 17, 18, 19, 20, 21, 22 and 23 of EU Regulation 2016/679, in full, at the end of this policy, by sending a written communication to the address indicated: privacy@alper.it.

Furthermore, you have the right to object, at any time, to the processing of your data, as well as to the portability of your data.

Without prejudice to any other administrative and judicial appeal, if you believe that the processing of your data violates the provisions of EU Reg. 2016/679, pursuant to art. 15 letter f) of the aforementioned EU Reg. 2016/679, you have the right to lodge a complaint with the Guarantor for the protection of personal data and, with reference to art. 6 paragraph 1, letter a) and art. 9, paragraph 2, letter a), you have the right to withdraw the consent given at any time.

Art. 7 Legislative Decree 196/2003. Rights attributed to the interested party.

The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet recorded, and their communication in an intelligible form.

The interested party has the right to obtain the indication:

  1. the origin of personal data;
  2. the purposes and methods of the processing;
  3. the logic applied in case of processing carried out with the aid of electronic tools;
  4. the identity of the owner, manager and the representative appointed under Article 5, paragraph 2;
  5. of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents.
The interested party has the right to obtain:
  1. updating, rectification or, when interested, integration of data;
  2. the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those that do not need to be kept for the purposes for which the data were collected or subsequently processed;
  3. the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible o involves the use of means that are manifestly disproportionate to the protected right.

    The interested party has the right to object, in whole or in part:

    1. for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection;
    2. to the processing of personal data concerning him for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
